Limitations of Liability: Nutrition Labeling

RL Food Testing Laboratory (RLFTL) provides nutritional information using U.S. FDA and Health Canada compliant nutrition label software, with the accuracy of the label content 100% dependent on what we receive from you, our clients. RLFTL is not responsible for any errors that may occur based on inaccurate or incomplete information, or the poor product quality received from the Client. The Client is responsible for providing full recipe details, including ingredients, sub-ingredients for processed foods, and ingredient quantities, to use for processing the Nutrition Label. If nutritional facts for specific brands are not available, RLFTL provides the clients the option to use USDA equivalents, but not without your permission. By using our template, you (client) consent to RLFTL to utilize the USDA equivalent nutrition facts in our database. When lab testing is not used to determine nutrition content, all recipes without the brined, fried, cold-pressed, etc. prep method automatically use USDA equivalents to achieve a Nutrition Facts label.

IMPORTANT REVIEW AND APPROVAL REQUIREMENT

Client is solely responsible for reviewing and approving all Nutrition Facts Panels, ingredient statements, allergen declarations, claims, serving sizes, nutrient values, and all other label content prior to printing, publication, distribution, or commercial use.  The label information provided by RL Food Testing Laboratory, Inc. is generated using the product specifications, formulations, ingredient information, and other data supplied by Client. RL Food Testing Laboratory, Inc. does not independently verify the accuracy or completeness of information provided by Client.  Client must carefully review all completed labels and notify us in writing of any discrepancies, omissions, or concerns within five (5) business days of delivery. This review includes, without limitation, identifying nutrient values, serving sizes, ingredient listings, or other information that appears inaccurate, inconsistent, unexpected, or commercially unreasonable. If Client does not provide written notice of errors or concerns within five (5) business days, the labels shall be deemed fully reviewed, approved, accurate, and accepted by Client for all purposes.


LIMITATION OF LIABILITY

To the fullest extent permitted by law, RL Food Testing Laboratory, Inc. shall not be liable for any losses, claims, recalls, regulatory actions, lost profits, lost sales, reprinting costs, packaging costs, production delays, inventory losses, customer claims, retailer penalties, business interruption, or any other direct, indirect, incidental, consequential, or special damages arising from or related to the use of the labels or any alleged error, omission, or inaccuracy contained therein after Client approval or deemed approval.   Client assumes full responsibility for final verification and regulatory compliance of all labels prior to use in commerce.

Limitations of Liability: Laboratory

We provide nutritional information using US FDA and Health Canada nutrition label software, with the accuracy of the label content 100% dependent on what we rec      eive from you, our clients. Laboratory service results are dependent on both the input we receive from you regarding the ingredients in your product and the quality of the product sample you send to us. Product quality is dependent on the product temperature when shipped, the container used to ship your product to us and the integrity of the sample we receive from you. We are not responsible for any errors that may occur based on your input or the quality of the product we receive from you. RLFTL is not responsible for any consequential or other damages. All claims against RLFTL must be brought within 1 year from delivery of services to client. Damages, if any, are limited to the cost of service(s) rendered.
